These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the relationship between VAYGA SAS, a simplified joint-stock company with a capital of €506.64, registered with the Paris Trade and Companies Register under number 820 918 407, with its registered office located at 189 rue d’Aubervilliers, Paris, Voie A, Porte 20, 75018 Paris, operating under the trade name TANAT coffee, a company specializing in roasting specialty coffee, and any natural or legal person purchasing products and/or services offered by VAYGA (hereinafter “the Customer”)

These Terms and Conditions set forth the rights and obligations of the parties in connection with the sale of products and services offered by VAYGA, whether through its website https://tanat.coffee or any other distribution channel.

Any order placed with VAYGA implies full acceptance of these Terms and Conditions, which take precedence over any other document provided by the Customer. VAYGA reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date the Customer places the order.

1. PURPOSE

The purpose of these Terms and Conditions is to define the rights and obligations of the parties in connection with the online sale ofspecialty coffees, equipment, and offered by TANAT.

By placing an order, the Customer expressly acknowledges that they have read and accepted these Terms and Conditions. VAYGA SAS reserves the right to modify the T&C at any time and without notice. The modifications will apply only to orders placed after their effective date.

2. PRODUCTS

TANAT offers freshly roasted specialty coffees as well as a selection ofequipment for coffee preparation.

Coffee is sold in packages whose weight may vary within the legal tolerances applicable to foodstuffs, in accordance with the provisions of Law No. 78-690 of October 25, 1978. 

The product descriptions and photographs on the website are provided for informational purposes only. Although TANAT strives to ensure the accuracy of the information, it is not contractually binding, and the company shall not be held liable for any minor differences between the information and the product delivered.

3. ORDERS

3.1 Placing an Order

All orders are subject to availability of stock and roasting schedules.

Shipping may take up to 10 business days depending on coffee availability and the roasting schedule. The order is shipped only when all the products in the order are available. 

Once your order has been confirmed, you will receive a confirmation email. All orders require mandatory payment by the Customer.

A tracking link will be provided upon shipment. The Delivery times listed are provided as guidelines and do not bind TANAT in the event of a delay beyond its control.

3.2 Product Availability 

The delivery times listed in the product descriptions are expressed in business days (no shipments on Saturdays, Sundays, and holidays) and allow the Customer to estimate their expected delivery date.

However, since inventory levels are not updated in real time, the Customer may order a coffee that is no longer available.

  • Permanent unavailability : TANAT will notify the Customer via email and offer an alternative solution that meets their needs. If no solution is suitable, the order may be canceled and refunded.
  • Temporary unavailability : TANAT will notify the Customer via email as soon as the product is back in stock. If the unavailability is prolonged, TANAT will offer either an equivalentor a refund for the order.

3.3 Modification or Cancellation

Once the order has been confirmed, no changes or cancellations will be possible, except in the case ofan obvious error on the part of TANAT.

The information provided by the Customer when placing an order will be used for shipping purposes. TANAT cannot be held liable for any errors in the contact information provided by the Customer.

4. SUBSCRIPTIONS

TANAT offers coffee subscriptions with regular shipping based on the frequency chosen by the Customer.

When signing up, the Customer selects the frequency of delivery, the type of Grind Type and may specify certain preferences. However, the coffees sent as part of the subscription are selected by TANAT, based on availability and seasonality of the coffees.

The subscription can be canceled at any time from thecustomer portal, at no cost and without notice.

For technical reasons, it is not possible to combine in a single shopping cart a subscription and individual items such as coffee or equipment individually.

5. DELIVERY

5.1 Shipping and Delivery Times

Orders are shipped within a maximum of 10 business days after the order is confirmed.

The delivery time depends on the carrier selected and begins on the day of shipment, not the day the order is placed.

The timeframes listed are provided for for informational purposes only and may vary depending on the destination country as well as periods of high volume (Christmas, holidays, etc.).

5.2 Choice of carrier

Customers can choose their delivery method:

The Customer may choose their delivery method, with or without a signature, depending on the options offered by our partner carriers.

TANAT shall not be held liable for delivery errors related to the information provided by the Customer at the time of ordering.

The shipping fee depends on the carrier selected by the Customer. The corresponding amount is specified before the purchase is confirmed.

5.3 Shipping outside the European Union and customs duties

Orders shipped outside the European Union or to certain specific destinations may be subject to customs duties, import taxes, or other fees imposed by the country of delivery.

These fees, which vary depending on each country’s customs regulations, are the sole responsibility of the Customer. VAYGA SAS (TANAT) has no control over these charges and cannot under any circumstances be held liable for them.

It is the Customer’s responsibility to check with the relevant local authorities in order to anticipate any additional costs associated with the importation of their order.

In the event that the Customer refuses the package ordelivery is impossible due to non-payment of these fees, no refund for the order and shipping costs may be claimed.

5.4 Delivery Delays and Liability

The delivery times listed on the website of VAYGA SAS (TANAT) are provided as estimates and depend solely on the selected carrier.

Once the package has been handed over to the carrier, VAYGA SAS (TANAT) no longer has control over the delivery time and cannot be held responsible for any delays, regardless of the reason (customs, logistical disruptions, strikes, weather conditions, etc.).

The Customer acknowledges that any delay in delivery shall not give rise to a refund of shipping costs or compensation from VAYGA SAS (TANAT).

If there is a delivery issue, the Customer must contact the carrier directly using the tracking information provided at the time of shipment.

5.5 Delayed or Lost Packages

If the package is lost or undelivered, the Customer must contact the carrier’s customer service directly.

If the issue cannot be resolved with the carrier, the Customer may contact us at hello@tanat.coffee , providing the order reference. We will take the necessary steps to obtain a refund if the situation warrants it. 

However, if the Customer chooses a delivery option that does not require a signature, Tanat cannot be held liable in the event of loss, theft, or delivery of the package to a mailbox or any other location deemed secure by the carrier. The Customer assumes full responsibility for this choice of delivery method.

6. RIGHT OF WITHDRAWAL & RETURNS

6.1 Coffee and perishable goods

In accordance with current legislation, coffee and other perishable goods cannot returned or exchanged, except in the case of a proven error on our part.

If the delivered product does not match the order, the Customer may obtain a refund after approval by our customer service department.

The selection of product options (Grind Type, size, quantity, etc.) is the Customer’s sole responsibilityand will not be grounds for a return or refund in the event of an incorrect selection made during the ordering process.

6.2 Equipment

The Customer has a statutory period of 14 days from the date of receipt of the order to exercise their right of withdrawal and return an item.

Returns must meet the following conditions:

  • The equipment must be returned in its original packaging, unused and in perfect condition.
  • None exchange are possible; only refunds are accepted.
  • The return shipping costs are the responsibility of the Customer.

An exchange or refund will only be possible only in the following cases :

  1. Manufacturing defect confirmed.
  2. Damage caused by the carrier during delivery.

In such situations, the Customer must provide proof of the malfunction or defect (photo or video) to our customer service department at hello@tanat.coffee so that we can assess the request.

 

7. PRICES AND PAYMENT

The prices listed on the website are in euros (€), including all taxes (TTC).

The final amount may vary depending on the applicable VAT rate in the Customer’s country of residence. This variation will be automatically reflected in the shopping cart at checkout.

Any declaration of the value of goods for customs purposes shall be equal to the sum of the selling prices of the products ordered.

Payment is made online, exclusively via secure payment methods offered on the website.

VAYGA SAS (TANAT) reserves the right to change its prices at any time. However, products will be billed at the rate in effect at the time the order is confirmed.

The prices shown may vary depending on several factors, including:

  • Fluctuations in supplier costs (e.g., fluctuations in raw material prices).
  • Changes in logistics costs.
  • Changes to applicable taxes.

Any order confirmed before a price change will be billed at the original rate. The new rates will apply only to orders placed after they have been updated on the website.

8. WARRANTIES AND LIABILITY

TANAT guarantees quality and freshness of its coffees, in accordance with its roasting expertise and the technologies used.

If you have a problem with a product, please contact our customer service department at hello@tanat.coffee, specifying their order number so that we can process their request.

TANAT cannot be held responsible for delivery delays caused by carriers or exceptional circumstances (strikes, natural disasters, adverse weather conditions, etc.).

9. PERSONAL DATA

The personal information collected during the order processing is used exclusively to manage, track, and ship purchases. It will under no circumstances be sold to third parties.

In accordance with current regulations on the protection of personal data, including the General Data Protection Regulation (GDPR), the Customer has the following rights regarding their data:

  • Right of access : to obtain a copy of the personal data held by TANAT.
  • Right to rectification : Request the correction of inaccurate or incomplete information.
  • Right to erasure : Request the deletion of your data when applicable.

10. DISPUTES AND GOVERNING LAW

These Terms and Conditions are governed by French law.

In the event of dispute, the parties agree to seek an amicable solution before taking any legal action. The Customer may submit a complaint to hello@tanat.coffee.

In the absence of an amicable agreement, any dispute relating to the interpretation or performance of these Terms and Conditions shall be submitted to the competent courts of the Paris jurisdiction, unless otherwise required by mandatory law.
